Finally determined 

The term finally determined technical mean that judgment or order on the application is not subject to further appeal or discretionary review. In the Australian Immigration process, it depends on how you
applied:

Non-Fast Track applicants- A protection visa application is finally determined when:

  • The application was declined by the Department and he/she did not acquire merits review of that decision with the Administrative Appeals Tribunal (AAT), or
    The applicant sought merits review of the refusal decision but the AAT confirmed the decision to refuse the protection visa.

Fast Track applicants- A protection visa application is finally determined when:

  • IAA affirmed the decision to reject the protection visa application

Excluded Fast Track applicants- A protection visa application is finally determined when:

  • The applicant was denied the protection visa by the Department and the decision cannot be reviewed at IAA since they are an excluded Fast Track applicant.
